At AZpartygigs, your membership is free. You only pay a 10% fee from your total gig price (which is the deposit/small booking fee that is submitted by the customer at the time of your booking.) You will receive the remainder at the time of your performance. There are no monthly fees associated with maintaining your gig and contact information on this platform.

*Some gigs will require insurance; prior to booking your first gig. AZpartygigs can send you a list of low-cost insurance companies to use, with quotes starting at less than $20 per month.

*A one-time fee of $20 will be required for AZpartygigs to do a background check. Once you submit the following form, we will send you an invoice.

Welcome to AZpartygigs, the premier online platform for local entertainment services in Arizona. Referred to as “AZpartygigs,” “we,” “us,” or “our,” we offer a dedicated service to connect customers with local entertainers and help artists manage their gigs effortlessly.

By accessing or using any part of our website, you agree to adhere to the Terms and Conditions outlined in this document. These Terms and Conditions govern all interactions with our platform, and it is important that you read and understand them before using our services. If you disagree with any part of these terms, please do not use our site, app, or any associated services. Note that any new features or tools introduced to the platform will also be governed by these terms.

To use the AZpartygigs website and mobile app, you must be at least eighteen (18) years old. By engaging with our platform, you confirm that you have read, understood, and agree to these Terms and Conditions, which constitute a legally binding agreement governed by the laws of the State of Arizona, United States. If you do not accept these terms, please do not use our website, app, or any related services. In this context, “you” or “your” refers to the individual or entity using our platform.

1. Performance:
The Entertainer agrees to deliver the services outlined in their listings with a high degree of professionalism and skill. It is essential that the Entertainer meets or exceeds the expectations set forth in their service descriptions to maintain their status as an active member of AZpartygigs. The Entertainer must ensure that their performance adheres to the standards described in their profile and any agreements made with customers.

2. Consequences of Non-Performance:
Should the Entertainer fail to complete a scheduled performance as agreed, AZpartygigs reserves the right to terminate the Entertainer’s listing on the platform. In such instances, the customer shall be entitled to refuse payment for any portion of the performance that was not delivered. The Entertainer will forfeit any compensation for incomplete services, and AZpartygigs will not be liable for any resulting losses or damages incurred by the customer.

3. Independent Contractor:
The Entertainer acknowledges and agrees that their relationship with AZpartygigs is that of an independent contractor, not an employee. This Agreement does not create any form of partnership, joint venture, or employment relationship. As an independent contractor, the Entertainer is responsible for all taxes, insurance, and other legal obligations related to their services. AZpartygigs will not withhold taxes or provide employee benefits.

4. Insurance:
The Entertainer agrees to secure and maintain, at their own expense, a general public liability insurance policy that is adequate to cover any potential claims arising from their performances. This insurance must remain in force throughout the term of the Entertainer’s engagement with AZpartygigs. The Entertainer is required to provide AZpartygigs with proof of insurance on a monthly basis. Failure to provide such proof may result in suspension or removal from the platform.

5. Limitation of Liability:
AZpartygigs disclaims any responsibility for damages or injuries that may occur during the Entertainer’s performance. The Entertainer assumes full liability for any claims or actions arising from their services. AZpartygigs shall not be held liable for any harm or loss that occurs during the entertainment performance, and the Entertainer agrees to indemnify AZpartygigs against any such claims.

6. Background Check:
To ensure the safety and reliability of our platform, the Entertainer agrees to undergo a background check conducted by AZpartygigs. The cost of the background check, which is $20, will be borne by the Entertainer. AZpartygigs will perform the background check before listing the Entertainer on the platform. The results of the background check will be used to assess the suitability of the Entertainer for inclusion in our network.

7. Booking Fee:
AZpartygigs will charge a booking fee of 10% of the total booking amount for each performance arranged through the platform. This fee will be deducted from the total amount payable to the Entertainer. The remaining balance will be paid directly to the Entertainer by the customer at the time of the performance. This fee structure ensures that AZpartygigs can continue to provide and maintain the platform for both entertainers and customers.

7. Property Rights
AZpartygigs does not hold ownership rights to the content or intellectual property related to the entertainment services listed on the platform. Entertainers retain full rights to promote and book their gigs independently of AZpartygigs, including through their own websites or other channels. AZpartygigs will not claim any ownership over the services provided or limit the Entertainer’s ability to market their services outside of the platform.

8. Complaints and Non-Contracted Performances:
AZpartygigs is not responsible for any issues arising from performances booked outside the platform, including incomplete services, poor quality of performance, or failure to show up. If the Entertainer accepts bookings or performs outside of the agreements facilitated through AZpartygigs, AZpartygigs will not be held liable for any related complaints or disputes. Any issues or claims arising from such non-AZpartygigs performances must be addressed directly by the Entertainer and the customer involved.

9. Termination:
AZpartygigs reserves the right to terminate this Agreement and remove the Entertainer from the platform at its sole discretion. Termination may occur for any reason, including but not limited to non-compliance with the terms of this Agreement or failure to meet performance standards. AZpartygigs can provide written notice to the Entertainer specifying the reasons for termination. Upon termination, the Entertainer will cease to be listed on the platform, and any further obligations or responsibilities will be nullified.

10. Compliance and Responsibility
The Entertainer agrees to fully comply with all terms and conditions outlined in this Agreement. The Entertainer is responsible for ensuring adherence to all requirements set forth, including performance standards, insurance obligations, and background check procedures. Non-compliance with these terms may result in removal from the AZpartygigs platform and other consequences as deemed appropriate by AZpartygigs. By accessing and using the AZpartygigs platform, you acknowledge that you have read, understood, and agreed to abide by these Terms of Service.
